An agriturismo is not simply a hotel or B&B located on a farm.

It is first an agricultural business. Italian law allows that agricultural business to provide hospitality, meals and other tourism activities as a complementary part of the farm.

For someone considering a small hospitality property in Italy, the agriturismo structure can be very attractive. It can offer tax advantages, access to agricultural grants and incentives, and the ability to operate hospitality in places where a conventional hotel might be difficult or impossible.

But those advantages come with real requirements. You cannot simply buy a rural property, call it an agriturismo and operate it as a hotel. The agricultural activity has to be real. Agriculture Comes First

The basic principle behind an agriturismo is that agriculture remains the primary activity and hospitality is connected to it.

That does not mean that farming has to produce more cash than the hospitality business. The rules are more nuanced than that and vary by region. But the property must be an operating agricultural enterprise, and the agricultural activity has to meet the applicable tests established by Italian and regional law.

The farm might produce wine, olive oil, fruit, vegetables, livestock, honey or other agricultural products. The tourism operation then sits alongside that activity.

This is one reason the agriturismo model can work particularly well for small, experience-oriented properties. Farming is not simply scenery around the hotel. It can become part of the operating model and part of what guests experience.

Why Use the Agriturismo Structure?

There are several potential advantages.

Tax Treatment

Agricultural businesses in Italy can receive tax treatment that is different from a normal commercial hospitality business.

Depending on the structure and circumstances, agricultural income may be assessed using cadastral values rather than actual income. Certain agriturismo activities may also qualify for simplified or forfait tax regimes.

VAT treatment can also be favorable for qualifying agricultural and agriturismo activities.

The specifics matter enormously here. The tax treatment of the agricultural business, accommodation, food and beverage, property ownership and other services can all be different.

Do not assume that because something is called an agriturismo every part of the business receives agricultural tax treatment.

Property Acquisition

Professional agricultural operators can also receive significant benefits when purchasing agricultural property. Two statuses are particularly important:

IAP, or Imprenditore Agricolo Professionale, meaning Professional Agricultural Entrepreneur.

CD, or Coltivatore Diretto, generally translated as Direct Farmer.

Qualifying purchasers may receive reduced registration, mortgage and cadastral taxes when acquiring agricultural property.

For example, the normal registration tax on agricultural land can be substantial. An eligible IAP or CD may instead qualify for significantly reduced fixed taxes.

These benefits normally come with conditions, including maintaining the agricultural activity for a required period after the acquisition. If those conditions are not met, the tax benefit can potentially be clawed back.

This is something to understand before purchasing the property, not afterward.

Property Taxes

Agricultural land operated by qualifying agricultural entrepreneurs may also receive exemptions or reductions from certain municipal property taxes.

Again, the treatment depends on the property, municipality, ownership structure and agricultural status of the operator.

Grants and Incentives

Agricultural businesses can also gain access to funding that would not normally be available to a conventional hotel. Potential sources include EU, national and regional programs supporting:

rural development
agricultural equipment
farm infrastructure
environmental improvements
energy efficiency
sustainable agriculture
restoration of rural buildings
diversification into agritourism
The Common Agricultural Policy and related regional programs can be particularly relevant.

These programs change frequently. Some are grants, some are subsidized financing, and some take the form of tax credits or other incentives.

They should be viewed as opportunities rather than something the business model depends upon.

The IAP

The IAP is one of the most important concepts to understand when considering an agricultural business in Italy. An Imprenditore Agricolo Professionale is a person who meets statutory requirements relating to professional agricultural activity.

The general framework requires the individual to devote a significant portion of working time to agriculture and derive a significant portion of income from agricultural activities. Professional knowledge or agricultural competence must also normally be demonstrated.

The commonly referenced thresholds are at least 50% of working time and 50% of employment income, although specific rules and exceptions can apply.

IAP status is formally recognized through the appropriate authorities. It is not simply a title that the company gives someone. For a company operating an agricultural business, the structure becomes more complicated. The company may need an IAP-qualified individual in a management role, and additional requirements can apply depending on the type of entity.

This should be worked out with the commercialista and agricultural advisor when the ownership structure is being designed. Trying to add an IAP after everything else has already been established can create unnecessary problems.

The Property Matters Too

An agriturismo is generally expected to operate from buildings associated with the agricultural property.

The intent is to preserve and reuse rural structures rather than create an unrelated hospitality development on agricultural land.

Renovation and adaptation are possible, but planning rules, building classifications, landscape restrictions and historic preservation requirements can significantly affect what can be done.

This is particularly important in Italy because two properties that look nearly identical can have completely different planning constraints. Agricultural zoning can sometimes provide opportunities that would not exist for a conventional hospitality business, but it should not be interpreted as a shortcut around planning regulation.

Before purchasing a property, understand exactly:

what each building is legally classified as
which buildings can be used for guest accommodation
what can be renovated or expanded
whether a change of use is required
what landscape or historic restrictions apply
whether existing structures and systems are compliant
what approvals are required for the intended hospitality use
The physical property and the agricultural business need to work together.

Regional Rules Are Important

Agriturismo law is not administered through one identical national operating standard. Italy establishes a broad legal framework, but many of the practical rules are regional. That means an agriturismo in Tuscany may operate under different requirements than one in Umbria, Piedmont or Sicily.

Regional regulations can determine things such as allowable accommodation, food service, activities, operating limits, agricultural calculations and administrative requirements.

Municipal rules add another layer. The question is, "What are the rules for this property, in this municipality, in this region, under this ownership and operating structure?"

Hospitality Is Still Hospitality

Being an agricultural business does not remove the normal obligations that come with operating accommodations.

Depending on the property and services being offered, an agriturismo may still need registrations and approvals covering areas such as:

accommodation
food preparation and service
health and sanitation
fire safety
swimming pools
employees
guest reporting
alcohol
insurance
wastewater and environmental compliance
The exact requirements depend on the operation.

A six-room agriturismo serving breakfast has a very different compliance profile from a twenty-room property with a commercial kitchen, pool, spa, events and extensive food and beverage service.

This is another place where the word agriturismo can be misleading. The agricultural structure may create advantages, but it does not make the hospitality operation informal.

Accounting Needs to Match the Structure

Agricultural activity and agriturismo activity need to be accounted for correctly. Depending on the business structure, different activities may receive different tax or VAT treatment. The company therefore needs records that make it possible to distinguish among the various sources of revenue and expense.

This becomes increasingly important as the hospitality operation becomes more sophisticated. A small farm renting two rooms has relatively simple accounting. A full-service property with accommodations, meals, alcohol, activities, agricultural production, outside vendors and employees does not.

The operating structure should be designed with the commercialista before opening rather than reconstructed after the business is running.

The Tradeoff

The agriturismo structure can be extremely useful for the right property. It can make a rural hospitality project economically possible, provide access to favorable agricultural rules and incentives, and create a natural connection between the property, the land and the guest experience.

But it is not a loophole for operating a hotel on agricultural land. The farm has to be real. The agricultural requirements have to be maintained. The ownership and management structure has to qualify. Regional rules have to be followed. And the underlying hospitality operation still needs to meet the standards expected of any professionally operated property.

That is the basic tradeoff. You receive some meaningful advantages because you are operating an agricultural business. In return, you actually have to operate an agricultural business.

Before You Buy

If you are considering an agriturismo, much of the important work should happen before the property purchase.

At minimum, we would want clear answers to these questions:

Does the property and intended agricultural activity qualify for an agriturismo?
What agricultural activity will actually be carried out?
How will the agricultural and hospitality activities satisfy the regional requirements?
Who will hold the required agricultural qualifications, including IAP status if applicable?
Does the proposed company and ownership structure qualify for the agricultural benefits being assumed?
Which acquisition tax benefits actually apply?
What happens if the agricultural requirements are not maintained?
What hospitality activities are permitted on the property?
What building, planning and landscape restrictions apply?
What licenses and approvals will be required before opening?
Which tax and VAT regimes will apply to each part of the business?
Which grants or incentives are currently available?
Do this work before underwriting the project around the benefits of being an agriturismo.

The structure can be powerful. It should be one of the inputs into deciding whether a property works, not an assumption used to make a property work.

Italian agricultural, tax and hospitality rules are detailed, change over time and vary considerably by region and individual circumstances. This guide is intended as an orientation to the structure, not legal, tax or investment advice. Confirm the current requirements with qualified Italian agricultural, legal and tax professionals before relying on any of the specific tax treatments or qualification rules described here.
